Don't screw your friend over – Being an Indemnitor
By Steven Jones
An indemnitor is someone who co-signs a bail bond in order to get someone out of jail on a temporary basis. It's as simple as that really, the process isn't even particularly difficult, yet people are still put off by concerns they may have. The biggest problem any indemnitor will face comes when the prisoner skips out on their bail. This means that they have not fulfilled the conditions of their bail (for example not appearing in court when summoned) and the bail could well be forfeited by the judge. This means that the financial burden of the bail bond will ultimately fall upon the indemnitor, and this could be a huge amount of money. Therefore, it's not a good idea to bail someone out of jail unless you can trust them completely. On the other hand, it's an extremely good thing to do and can be incredibly helpful if you trust the person, so you should think of it as a good deed rather than a chore. Being extra cautious is the key, and will mean that you won't have any nasty surprises during the process. Don't make any rash decisions or you could end up paying for them heavily. Ask yourself questions, for example, has this person been arrested before? What happened last time they were arrested? Do they deserve my help? If of the answers to these questions fill you with doubt, then it's probably best not to proceed with the bail bonds process. It's all very simple, and all you'll have to do is provide some detailed information with regards to your situation, and the situation of the prisoner. Within a matter of hours your friend can be released from jail and walking home with you. You may be required to provide collateral, which will be any assets that you can provide to cover the cost of the bail bond if the defendant skips out on their bail. If you can't find reasonable collateral, then you should rethink whether you should be proceeding. However, the chances are you won't have to even think about actually using that collateral, so use your discretion when making a decision like this.
